1. Agreement
These Terms of Use apply to illset.com in its pre-launch form (the Site), operated by ILLSET Limited (ILLSET). By using the Site, pre-registering or posting to the Green Room, you agree to these terms. If you do not agree, do not use the Site.
You must be at least 16 years old to use the Site. If you use the Site on behalf of a business (a venue, promoter or management company) you confirm you are authorised to bind that business.
2. What the Site currently is
The full ILLSET platform is temporarily unavailable while we prepare for launch. During this period the Site provides information, an email pre-registration list, a public community wall and a referral scheme. Nothing on the Site is an offer to supply the platform, a booking service, or a promise of any particular feature, launch date, price or availability. Forward-looking statements are plans, not commitments.
3. Existing ILLSET accounts
Existing accounts, profiles and associated content have been retained. We intend to restore access when the platform relaunches, and we will email account holders at that point. We do not guarantee a specific relaunch date. Where account data must be changed or removed for legal, security or technical reasons, we will act reasonably and, where practicable, tell affected account holders. Requests to access or delete existing account data can be made at privacy@illset.com.
4. Pre-registration
Pre-registering places your email address on our launch list and is your consent to receive launch-related email from us. It does not create an account, reserve a username, or guarantee access, pricing or priority. You must use an email address you control and must not register someone else's address. You can unsubscribe at any time via the link in any email or by emailing privacy@illset.com.
5. The Green Room (community wall)
The Green Room is a public board that anyone can post to without an account. It is governed by these terms and by our Community Guidelines, which form part of this agreement.
5.1 Your responsibility for content
You are solely responsible for what you post. You confirm that your content is yours to post, is accurate, does not infringe anyone's rights, and does not breach any law (including the Harmful Digital Communications Act 2015, the Defamation Act 1992, the Fair Trading Act 1986 and the Human Rights Act 1993 in New Zealand).
5.2 Licence you give us
You keep ownership of what you post. You grant ILLSET a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, reproduce, adapt for formatting, publish, and publicly display your post, your display name, role and location, including reproducing posts in ILLSET marketing and social media (for example as screenshots). This licence continues for posts you have made even if you later stop using the Site, and ends for a given post a reasonable time after we remove it at your request, except for copies already distributed or retained for legal reasons. You waive any moral rights to the extent permitted by law, and you are not entitled to payment.
5.3 Public by design
Posts are visible to everyone, can be indexed by search engines, and cannot be recalled once published. Do not post personal information about yourself or others that you are not comfortable being public.
5.4 Moderation
We may hide, edit for formatting, or delete any post, and block access to the Site, at our discretion and without notice — for example where a post is reported by multiple users, is caught by our spam filters, or breaches these terms. We are under no obligation to monitor content, and we do not endorse any post. If your post is removed and you think that was wrong, email hello@illset.com and we will review it.
5.5 Other users' content
Content on the Green Room is provided by third parties. We do not verify it. Any reliance on it, and any dealings you enter into with other users, are at your own risk.
6. Referral programme
- Pre-registered users receive a personal referral link. Referrals are counted when a new person pre-registers with a valid email address after arriving via that link.
- Any benefits described on the Site (for example early-access waves or a launch-wall feature) are promotional, have no cash value, are not transferable, and may be changed or withdrawn at any time.
- Self-referrals, disposable or auto-generated addresses, bulk or unsolicited messaging, paid placement of your link, or any automated or deceptive method of inflating referrals are prohibited. We may void referrals and remove participants who breach this clause. Our determination of referral counts is final.
- You must not present yourself as speaking for ILLSET when sharing your link, and you must comply with anti-spam law when sharing it.
7. Acceptable use
You must not:
- use the Site for any unlawful, harmful, misleading or fraudulent purpose;
- post spam, malware, phishing links, scams, or unsolicited commercial or ticket-resale promotion;
- harass, threaten, defame, or post hateful content, or content that is sexual, violent or otherwise inappropriate for a professional industry space;
- impersonate any person, act or organisation, or misrepresent your affiliation with one;
- scrape, crawl, harvest data, or use bots, or attempt to bypass rate limits, moderation or our anti-abuse controls;
- probe, scan or interfere with the Site's security or availability, or access non-public areas such as our moderation tools;
- reverse engineer or copy any part of the Site other than for personal, non-commercial use.
8. Intellectual property
The ILLSET name, logo, design, copy, screenshots and software are owned by or licensed to ILLSET Limited and are protected by intellectual property law. We grant you a limited, revocable, non-transferable licence to view and use the Site for its intended purpose. All other rights are reserved. Third-party names and logos shown on the Site (for example partner venues and artists) are used with permission and remain the property of their owners.
9. Third-party links
The Site contains links posted by users and by us to third-party sites. We do not control and are not responsible for those sites or their content, and a link is not an endorsement.
10. Availability
The Site is provided on an “as is” and “as available” basis. We may change, suspend or discontinue any part of it, including the Green Room and the referral programme, at any time without notice.
11. Disclaimers and liability
To the maximum extent permitted by law, we exclude all warranties, terms and conditions not expressly set out here, including implied warranties of merchantability, fitness for purpose and non-infringement, and we make no warranty that the Site will be uninterrupted, secure or error-free or that user content is accurate.
Consumer law. Nothing in these terms limits rights you have under the New Zealand Consumer Guarantees Act 1993, the Fair Trading Act 1986, or the Australian Consumer Law, where those rights cannot lawfully be excluded. Where you use the Site for business purposes, you agree that the Consumer Guarantees Act and sections 9, 12A and 13 of the Fair Trading Act do not apply, and that this exclusion is fair and reasonable.
Subject to the paragraph above, we are not liable for indirect, consequential, special or incidental loss, or for loss of profit, revenue, data, goodwill or business opportunity, however arising. Our total aggregate liability to you in connection with the Site is limited to NZ$100.
12. Indemnity
You indemnify ILLSET Limited against claims, losses and reasonable legal costs arising from content you post, your breach of these terms, or your infringement of another person's rights — except to the extent caused by our own breach or negligence.
13. Suspension and termination
We may restrict or block your access to the Site at any time if we reasonably believe you have breached these terms or created risk for us or other users. Clauses that by their nature should survive (including 5.2, 8, 11, 12 and 15) survive termination.
14. Changes to these terms
We may update these terms. The current version is always on this page with its last-updated date. Material changes will be notified to pre-registered users by email. Continuing to use the Site after a change means you accept it.
15. Governing law and disputes
These terms are governed by the laws of New Zealand, and you and we submit to the non-exclusive jurisdiction of the courts of New Zealand. If you have a complaint, email hello@illset.com first — we will try to resolve it within 20 working days before either of us starts proceedings. If you are a consumer resident elsewhere, this clause does not remove the protection of mandatory laws of your country of residence.
16. General
These terms, together with the Privacy Policy, Cookies notice and Community Guidelines, are the entire agreement between us about the Site. If any clause is unenforceable, the rest continues to apply. Our failure to enforce a right is not a waiver of it. You may not assign these terms; we may assign them as part of a business transfer. No third party may enforce these terms under the Contract and Commercial Law Act 2017 except a company in our group.
